Membership Agreement

ARTICLE 1 - PARTIES: This Membership Agreement (hereinafter referred to as the Agreement);

Located at Koca Camii Neighborhood, Lefke Street No:17 BURHANİYE / BALIKESİR, represented by burcuonline.com (hereinafter referred to as "burcuonline.com").

and the person whose name/surname and address is declared in the "Member Information" field (hereinafter referred to as Member) enter into this agreement under the following terms and conditions.

ARTICLE 2 - PURPOSE AND SUBJECT OF THE AGREEMENT:
This Agreement has been concluded to enable the member to benefit from the services provided by burcuonline.com, and to determine the rights and obligations of the parties.

ARTICLE 3 – DEFINITIONS:
The following terms shall be used in the meanings defined under this agreement.

Accordingly;
Member: A person who has applied for membership by accepting this agreement and whose application has been approved to benefit from products and/or services provided through burcuonline.com.

E-Mail Address: The electronic mail address declared by the member and registered to their account, whose usage, content and confidentiality is the responsibility of the member, defined during the registration of membership and can not be changed later.

Password: An alphanumeric string between 6 and 16 characters determined by the member, used together with the e-mail address to enable the system to recognize the member, mandatory for access to services provided by burcuonline.com through the website; all responsibility for its use and security belongs to the member.

Member Account: The account registered with burcuonline.com which members can use to benefit from various products or services foreseen by this agreement.

Product/Service: Goods sold or services provided via burcuonline.com.

Product/Service Price: The sales price of the product or service presented to members via burcuonline.com.

User: A real person who can visit the publicly accessible areas of the burcuonline.com website regardless of being a member or not, and is allowed to perform transactions in those areas.

Credit Card/Debit Card: Cards issued by authorized institutions that members can use for transactions on burcuonline.com, enabling purchase of goods and services or cash withdrawal without cash usage, either physical card or card number without physical existence, valid under relevant legislation.

Service Channels: Platforms exclusively owned by burcuonline.com such as mobile telecommunication applications, JAVA, SMS, WAP, Interactive TV (ITV), voice-response systems (IVR), Customer Service, kiosks and internet (burcuonline.com) infrastructure and similar.

Gift Points: Physical or non-physical numbers providing various advantages to members and/or users whose earning, allocation and usage conditions are exclusively within the authority of burcuonline.com.

Order Confirmation: Notification sent to the e-mail address registered at burcuonline.com and/or SMS to the mobile phone number for confirming the order placed on burcuonline.com, containing order details.

My Account Menu: The personal area accessed through burcuonline.com where members can track their transactions and order stages within burcuonline.com, and perform permitted operations.

SMS: Short Message Service.

Customer Service: The dedicated section of burcuonline.com where members can communicate verbally or in writing and receive information and consultation. Singular terms used in definitions also include plurals and vice versa wherever applicable.

ARTICLE 4 - MEMBERSHIP CONDITIONS:
4.1 Membership Application
4.1.1 burcuonline.com membership can be initiated by completing the membership form properly. Anyone who clicks on the relevant acceptance notification to apply for membership to burcuonline.com declares, accepts and undertakes that they have read and accepted all the terms of this agreement, meet the requirements for membership, and this agreement will bind them legally and by their will. burcuonline.com is a private club and reserves the right not to accept membership applications of persons who want to benefit from the services subject to this agreement.

4.1.2 The applicant declares, accepts and undertakes the accuracy and legality of the information provided at membership application. Membership may be canceled if the provided information is found to be false or illegal. In such case, the member shall not claim any products, services, expenses, compensation, etc. from burcuonline.com for any transactions made. The rights of burcuonline.com concerning the refund of paid amounts or return of delivered products are reserved.

4.1.3 Membership can be initiated from any of the service channels at the discretion of burcuonline.com. The member who wants to enter into the contractual relationship by applying for membership agrees and undertakes that legal relations will be established through electronic communication means, with the same legal consequences as a handwritten signature, and no separate signed confirmation is required.

4.1.4 The member is obliged to enter mandatory information accurately and completely into the membership application form. Members who meet the conditions must complete other requested information by burcuonline.com via website or customer service.

4.1.5 The member declares, accepts and undertakes that they have carefully read and accepted the terms of the agreement, are able to keep a copy if they wish, can easily reach modifications, additions, data transfers and usage conditions. Changes or additions to the agreement terms are presented to the member at first login; membership may be terminated without any compensation if acceptance is not clicked. Member undertakes to comply with membership conditions throughout the term.

4.2 Membership Start
When burcuonline.com initiates the membership, an e-mail confirmation is sent to the provided e-mail address. The member may start benefiting from burcuonline.com services upon acceptance and start of membership.

4.3 Use of Member Account
4.3.1 Each member may have only one account. The account is used solely to benefit from the services defined in this agreement. The member cannot use the services or account unlawfully, immorally, disturb others, resell services or generate income from them or use outside agreement purposes.

4.3.2 burcuonline.com reserves the right to terminate memberships without notice if multiple accounts are found or misuse occurs. Membership may be suspended or canceled if qualifications are not confirmed.

4.4 E-mail Address and Password
4.4.1 burcuonline.com sends membership details to the registered e-mail after acceptance. It is accepted that burcuonline.com is not responsible for undelivered messages due to technical causes.

4.4.2 Protecting the e-mail and password and all responsibilities related to their use belong to the member. The member accepts and undertakes that transactions and orders made through login are binding.

4.4.3 If third parties use member's e-mail or password causing damages or disputes that lead to compensation by burcuonline.com, burcuonline.com has the right to claim damages or reimbursements from the member and may suspend or terminate such memberships.

4.4.4 The member may change their password at any time via the website. In case of forgotten password, member can retrieve it through customer service or online instructions.

4.4.5 E-mail address registered to burcuonline.com cannot be changed by the member, but burcuonline.com may require changes or security measures including password changes. The member agrees to comply with such requests and will be notified by SMS or e-mail.

4.5 Member's Personal Information
4.5.1 Personal data such as name, surname, ID number, birth date collected at registration or later for security purposes cannot be changed by the member. Other personal details can be changed after verification.

4.5.2 The member agrees and consents that personal data stored by burcuonline.com may be used for statistical reporting, advertising, marketing, surveys or promotions without harming personal rights and will not be shared improperly.

4.5.3 Member acknowledges responsibility for confidentiality and security of personal data sent via email, fax or letter and that customer service correspondence may be recorded.

4.5.4 Member accepts that burcuonline.com and authorities have the right to inquire about member’s personal information and transactions, and will provide detailed information when requested.


4.6 Termination of Membership
4.6.1 If burcuonline.com suspects or detects third party use of a member account, the account may be closed and/or the agreement terminated without notice or compensation.

4.6.2 burcuonline.com may terminate membership at any time without cause. The member accepts no claims for damages or compensation. Terminated membership information remains stored for a determined period.

4.6.3 Member may unilaterally close their account anytime via website or by written request to customer service. Membership ends when burcuonline.com completes termination procedures. Reasons for termination may be asked. Reactivations are treated as new memberships.

4.6.4 Upon account closure, member acknowledges no rights or claims remain against burcuonline.com.

ARTICLE 5 - SERVICE CONDITIONS:
5.1 Member may place purchase requests for products/services offered on burcuonline.com according to price and conditions. burcuonline.com reserves the right to change characteristics or quantities. Images on the website may differ from actuals including packaging and sizes. Orders must be placed via site instructions; order confirmation will be sent via email and SMS including order number.

5.2 burcuonline.com acts as a platform providing promotional and reservation codes and collecting campaigns. Responsibility for services lies with the providers, burcuonline.com only mediates payments and publishes campaigns. It is neither the “provider” nor responsible under Law No. 4077.

5.3 Member agrees that product/service prices and shipping fees will be charged to payment cards registered on burcuonline.com, refunds, if any, will be made via the same card.

5.4 Member is solely responsible for transactions via their account. Losses due to incomplete or failed payments are member’s responsibility. burcuonline.com is not liable for member errors.

5.5 Although not obliged, burcuonline.com may cancel mistaken transactions upon member notification or ex officio, reverting accounts to prior status.

5.6 Member accepts no claims for service disruptions caused by unpredictable system failures, hardware or software issues. burcuonline.com will diligently address such issues.

5.7 burcuonline.com may change, cancel or add new service channels and conditions anytime. No seasonal guarantees for products/services are given.

5.8 Membership is free; connection and usage fees (internet, TV, phone, SMS, etc.) are member’s responsibility.

5.9 SMS transactions are chargeable and may vary by type. burcuonline.com may change prices without liability. SMS fees will appear on operator bills or prepaid credits. Operator tariff changes are not burcuonline.com’s responsibility.

5.10 burcuonline.com may charge service fees for customer service calls; changes will be notified to members.

ARTICLE 6 - ADDITIONAL SERVICES:
6.1 Acceptance includes agreement to use terms for all related site areas.

6.2 Member accepts campaign and promotion usage according to burcuonline.com specified conditions, with burcuonline.com reserving unilateral change rights.

6.3 Member agrees to use any bonuses, coupons or discounts within designated times or until membership ends; unused bonuses expire with no claims allowed. Bonuses cannot be converted to cash.

6.4 burcuonline.com may offer different proposals based on order and behavior analysis and change loyalty programs within designated periods.

ARTICLE 7 - LIABILITY:
7.1 To benefit from services, members may need to use third-party software whose terms prevail over this agreement in case of conflict.

7.2 Services provided can be expanded, limited, or stopped unilaterally at any time by burcuonline.com. Agreement terms may be modified. Member acknowledges this is not a binding warranty.

7.3 All rights to materials (text, images, graphics, sounds) on burcuonline.com belong to burcuonline.com. Member shall not use, allow use, publish or market these without written permission. Software copyrights belong to burcuonline.com and may not be copied or distributed. burcuonline.com is not liable for damages from unauthorized use; may claim damages and take legal action.

7.4 Liability disclaimers apply except in cases of gross negligence or fraud by burcuonline.com. Damages caused by member responsibilities may be legally claimed by burcuonline.com.

7.5 Failure to enforce rights does not mean waiver.

ARTICLE 8 - GENERAL PROVISIONS:
8.1 The membership relationship is established online; the contract becomes effective upon application and acceptance by burcuonline.com. The contract date is acceptance date.

8.2 Member cannot transfer rights or obligations to third parties.

8.3 Member acknowledges and accepts validity of records kept by burcuonline.com, which have binding evidentiary effect in disputes, as per article 193 of Turkish Code of Civil Procedure; waives right to challenge.

8.4 Turkish law applies; jurisdiction is Ankara Central Courts and Enforcement Offices.

8.5 Member’s declared address is the legal notification address unless stated otherwise; written notifications to this address are legally valid. Similarly, burcuonline.com’s address shown is legal notification address.

This Agreement consists of 8 (eight) articles. Person wishing to become a member declares that they have read the entire agreement, accept all provisions unconditionally, and confirm this declaration.

CLARIFICATION TEXT REGARDING THE PROCESSING OF PERSONAL DATA

1. Purpose of the Clarification Text and Our Company’s Role as Data Controller:

Our company BURCU ONLINE FOREIGN TRADE ONLINE SALES SITE and our online sales site www.burcuonline.com acts as the “data controller” within the scope of Law No. 6698 on the Protection of Personal Data (“Law”) regarding personal data of customers, and with this Clarification Text it is aimed to inform customers about the personal data processing activities carried out by BURCU ONLINE FOREIGN TRADE ONLINE SALES SITE and our online sales site www.burcuonline.com in accordance with the mentioned Law.

2. Purpose of Processing Personal Data of Customers:

3. Personal Data to Be Processed Based on Customers' Explicit Consent and Processing Purposes:

The personal data to be processed and the processing purposes based on explicit consent are indicated in the Consent Text.

4. Transfer of Customers’ Personal Data:

Customers’ personal data may be shared with group companies of BURCU ONLINE FOREIGN TRADE ONLINE SALES SITE and our online sales site www.burcuonline.com, company officials, subsidiaries, business partners, suppliers, shareholders, legally authorized public institutions and organizations, and private institutions within the scope of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law, including necessary activities such as planning and execution required to ensure the legal, technical, and commercial business security of related persons in a business relationship within BURCU ONLINE FOREIGN TRADE ONLINE SALES SITE and our online sales site www.burcuonline.com. 5. Method and Legal Basis of Personal Data Collection:

6. Rights of Customers as Personal Data Owners:

Pursuant to Article 11 of the Law, data subjects have the rights to; (i) learn whether their personal data are processed, (ii) request information if personal data have been processed, (iii) learn the purpose of processing and whether data are used in accordance with that purpose, (iv) know third parties to whom personal data are transferred domestically or abroad, (v) request correction if their personal data are incomplete or inaccurately processed and to have the relevant correction notified to third parties, (vi) request deletion or destruction of personal data when the reasons requiring processing no longer exist despite compliance with Law and related provisions, and to have such action notified to third parties, (vii) object to any outcome against them arising solely from automatic processing, and (viii) request compensation for damages in case of unlawful processing of personal data. Requests for exercising these rights can be submitted by data subjects by the methods specified in the Policy on Processing and Protection of Personal Data under Law No. 6698 by BURCU ONLINE FOREIGN TRADE ONLINE SALES SITE and our online sales site www.burcuonline.com. Kocaman Arge Consultancy and Innovation Services will evaluate and finalize such requests within 30 days.
